Acceptance of these terms

These terms set out the rules for using our website, www.dynamicvectors.co.uk (the "Site"). By using this site, you confirm that you accept these terms of use and that you agree to comply with them. If you do not agree to these rules you must not use this site.

You are also responsible for ensuring that all persons who access the Site through your internet connection are aware of these terms of use and other applicable terms and conditions and that they comply with them.

Applicable policies

The terms of the Privacy Policy are also applicable to your use of the Site and are deemed to be accepted by you. The Privacy Policy sets out the terms on which we process any personal data we collect from you, or that you provide to us. By using the site, you consent to such processing and you warrant that all data provided by you is accurate.

Variation

We may amend these terms from time to time. Every time you wish to use the site, please check these terms to ensure you understand the terms that apply at that time.

We may update and change the Site from time to time, for example, to reflect relevant changes to the services provided, the needs of the users or our business priorities.

Suspension or withdrawal of the site

The Site is made available free of charge. We do not guarantee that the site, or any content on it, will always be available or that use will be uninterrupted. We may, at any time, suspend, withdraw or restrict the availability of all or any part of the Site for business and operational reasons. We will try to give you reasonable notice of any suspension, withdrawal or restriction of service of the site.

Non-reliance

All information, material and other content on the Site is provided for general information only. Although we make reasonable efforts to update the information on the site, we make no representations, warranties or guarantees, whether express or implied, that the content on the Site is accurate, complete or up to date.

Confidential details

Some areas of the Site may require you to log in before you can access them. If you choose, or you are provided with, a user identification code, password or any other piece of information as part of security procedures in relation to your use of the site, you must treat such information as confidential and must not disclose it to any third party.

We have the right to disable any user identification code or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of the provisions of these terms of use.

Permitted use of the Site and materials

All design work featured on the Site or provided to our customers remains the property of Dynamic Vectors. This copyright does not pass to, or become shared with our clients or any third party at any stage of its production, use or sale for the purposes of a project. Should any individual, organisation or third party wish to utilise our work in any form, express permission must be obtained from one or more of the Dynamic Vectors partners in writing. Financial charges may apply.

We are the owner or the licensee of all intellectual property rights in the site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

Any use of the Site that could damage, disable, overburden or impair the Site or interfere with any other party’s use and enjoyment of the Site is prohibited.

In all circumstances where material from Dynamic Vectors or the Site has been approved for use elsewhere in any form, our status (and the status of any identified contributors) as the authors of content on the Site must always be acknowledged.

You must not use any part of the content on the Site for commercial purposes without obtaining a licence to do so from us or the relevant licensors in advance.

If you print, copy or download any part of or material from the Site in breach of these terms of use, your right to use the Site will cease immediately and you must, at our option, return or destroy any copies of the materials you may have made.

No use of Dynamic Vectors's logo or other artwork will be allowed for linking without a trademark license agreement.

Prohibited Uses

As a condition of your use of the site, you undertake to us that you will not use the Site for any purpose that is unlawful or prohibited under these terms. You may not use the site:

  • in any way that breaches any applicable local, national or international laws.

  • in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect.

  • for the purpose of harming or attempting to harm any third party in any way.

  • to send, knowingly receive, upload, download, use or re-use any material which does not comply with these terms.

  • to transmit, or procure the sending of, any unsolicited or unauthorised advertising and promotional material or any other form of solicitation (spam).

  • in any way which is prohibited elsewhere under these terms.

Cookies

We may employ the use of cookies. By accessing Dynamic Vectors, you agreed to use any active cookies in agreement with the Dynamic Vectors's Privacy Policy unless you elect to disable their operation when you access the Site.

Most interactive websites use cookies to allow website owners to understand the nature of the visits to their pages. Cookies are used by our website to enable the functionality of certain areas, making it easier for people visiting our website. Some of our affiliate/advertising partners may also use cookies.

Viruses

We do not guarantee that the Site will be secure or free from bugs or viruses but we ask all users to inform us immediately if they have concerns over the presence of such software within the Site.

You are responsible for configuring your information technology, devices, computer programmes and platform to access the Site. It is your responsibility to ensure that the device on which you access the Site is equipped with adequate virus protection software.

You must not misuse the Site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to the Site, the server on which the Site is stored or any server, computer or database connected to the Site. You must not attack the Site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Site will cease immediately.

Links to third party websites

Where the Site contains links to other websites and resources provided by third parties, these links are provided for your information only. We have no control over the contents of those sites or resources and any concerns you have over the suitability of such material should be brought to Dynamic Vectors’ attention as soon as possible. 

We provide any links only by way of convenience and the inclusion of any link does not imply endorsement by us of the third party website or resource or any association with its operators, even if we have credited them appropriately for their work. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them.

We take no responsibility for follow-on material which may be automatically selected for you by third party software during use of a link on the Site.

Using links to the Site

You may link to our home page, provided that you use the link in a way that is fair and legal and does not damage or take advantage of our reputation.

You must not establish a link to the Site in such a way as to suggest any form of association, approval or endorsement on our part where none exists. If you wish to imply such an endorsement you must formally apply to the Dynamic Vectors partnership and seek approval in writing.

You must not establish a link to the Site in any website that is not owned by you. The Site must not be framed on any other site, nor may you create a link to any part of the Site other than the home page.

We reserve the right to withdraw linking permission without notice.

Removal of links from our website

If you find any link on our Website that is offensive for any reason, you are encouraged to contact us and inform us at any stage. We will endeavour to review any such material and take a decision as to whether it is removed or left in place on the Site. We aim to consider requests to remove links but we are not obligated to do so or to respond to you directly.

 

Conclusion of contract

(1) All offers from Dynamic Vectors are subject to change and non-binding.

(2) They become binding either through delivery of a product or confirmation of an order.

(3) Oral, telephone and telegraphic agreements are only binding if they are subsequently confirmed in writing.

(4) Notifications

As far as the contractual partners communicate by electronic mail (e-mail), they recognise the unlimited effectiveness of the declarations of intent transmitted in this way in accordance with the following provisions.

The usual information in the e-mail must not be suppressed or bypassed by anonymisation. The e-mail must contain the name and e-mail address, the time of sending and a reproduction of the name of the sender at the end of the message. An email received within the scope of this provision is deemed to have originated from the other partner, subject to counter-evidence.

  

Stock availability 

The Site offers some ability for direct purchases. Potential customers should note that we produce bespoke badge designs for an initial client and our manufacture quantities are scaled to meet their requirements. The Site offers for private sale any additional stock over and above that initial order. As such, supply is limited and orders are fulfilled on a first-come, first-served basis. Our stock management and dispatch system is partly manual so in submitting an order via the Site third party customers should be aware that there is potential for ordering quantities beyond the stock we currently hold.

 

Pricing 

Our intention is for goods to be charged at prices shown on the product pages on the date the customer places the order. Prices should be correct at time of publication. Should a pricing error have been made on the Site then we reserve the right to correct it at the point of invoicing. Orders will be processed at our published prices; otherwise, in the case of any unexpected change in price, you will be informed and asked if you wish to reconsider your order before proceeding. All prices are stated in Pounds Sterling (£ GBP).

Payment  

Dynamic Vectors only accept PayPal or bank transfers.

If you are a client ordering a product, you may be required to pay a deposit before design work begins on your project. Dynamic Vectors will endeavour to take such deposits only when our design team is set to begin such work.

Clients who commission a bespoke product to be manufactured should note that fees are associated from the moment Dynamic Vectors begin work on that product and may well exceed the funds paid as deposit; as time and resources are expended. Generation of artwork carries associated design fees, which are payable whether or not the client ultimately decides to enter final production on the product for which it is intended. By ordering via our website, social media channels, email, or any other form of communication, clients accept liability to pay for time and resources expended by Dynamic Vectors in association with any such product. Should clients confirm that a product proof is approved for production, these costs will be incorporated into the final charge for the overall service.

If you are a first time customer, you may be required to pay the balance of your fee before Dynamic Vectors commit to final production, as tooling a moulds can be required for the creation of some of our products and carry and associated cost to us.

If you have not been required to pay up-front in the above fashion, payment is to be made within a week of delivery of your product. In some cases, payment must be made before despatch. Dynamic Vectors will inform you which method of payment is required in your individual circumstance.

By ordering via our website, social media channels, email, or any other form of communication, clients accept the above payment terms and their obligations to pay for service rendered.

Delivery  

We will endeavour to dispatch our products as soon as possible. We reserve the right to change delivery times due to unforeseen circumstances or staffing limitations. We reserve the right to change our postage at any time in line with the necessary cost.

Refunds, returns and exchanges

We do not accept refunds or exchanges unless there is a manufacturing fault with the product that is identified at the point of delivery. We will not accept the return or exchange of an item, nor issue a refund if we suspect it has been tampered with or intentionally damaged.

If you do find fault with your item please email admin@dynamicvectors.co.uk and we will aim to advise you on your options. 

When returning your product please enclose all original packaging. Please include a copy of your name so that we know who the package has been returned by.

We do not accept any responsibility for any items that are lost, stolen or damaged in transit whilst being returned to us. We recommend you return items via an insured and reliable postal service, for example Royal Mail Special Delivery Service.

Equally we cannot replace an order if you have incorrectly inputting your address.

If your parcel is lost in transit on its way to you then we bide by the Royal Mail's retail compensation policy for loss.

It is the responsibility of the customer to pay any import duty, custom charges or fees on the order.

Limitation of Liability

We do not exclude or limit in any way our liability to you where it would be unlawful to do so. 

This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.

We exclude all implied conditions, warranties, representations or other terms that may apply to the site or any content on it.

We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, even if foreseeable, arising under or in connection with:

  • your use of, or inability to use, the Site; or

  • your use of or reliance on any content displayed on the Site.

In particular, we will not be liable for:

  • loss of profits, sales, business, or revenue;

  • business interruption;

  • loss of anticipated savings;

  • loss of business opportunity, goodwill or reputation; or

  • any indirect or consequential loss or damage.

 

Governing Law and Jurisdiction

These terms of use, their subject matter and their formation (and any non-contractual disputes or claims) are governed by British law. We both agree to the exclusive jurisdiction of the courts of the United Kingdom.

Severability Clause

Should individual regulations of these conditions be or become wholly or partly ineffective, this does not affect the effectiveness of the remaining regulations of these conditions. The same applies in the event of a loophole.
